Some Frequently Asked Questions
Suppose you are a non-citizen of Mexico, and the property you are acquiring is located within Mexico’s restricted zone. In that case, that occupies a band within 50 kilometers (31 miles) of the coast or 100 kilometers of an international land border. According to Mexican law, you cannot hold Property in your name. Nevertheless, the government authorized the use of a trust (“fideicomiso”) to purchase property within the restricted zone, where you are the only Beneficiary, and the bank acts as the Trustee.
The other way is to incorporate a Mexican Corporation, and this national entity will acquire the Property.
In both cases, Whitebox Law can guide you through the process.
You are not required to be in Mexico during the majority of the process, but you must be present to sign your deed.
However, we can work with you to grant us a limited power of attorney for a Whitebox Law lawyer to sign on your behalf. In this case, you will not need to be present in Mexico.
As a general rule, if you are the Buyer, you should consider about 5-9% of the purchase price. This includes the Notary fee, acquisition tax, Trust setup fees, and the government’s permit to incorporate the Trust.
If you are the Seller, you should consider the Real Estate Agent’s fee and the Income Tax.
In Mexico, the services of a Notary Public are required in a real estate transaction. The Notary Public is a government-appointed official that gives full faith in the transaction. Whitebox Law guards your interests while coordinating the transaction with all parties, including the Notary.
In most cases 3-4 weeks is enough time to complete a property closing. We start our countdown as soon as we receive all documents from seller and buyer. You will be able to track your transaction progress status live as it happens any time of the day through Rundl.
Rundl is a secure online platform that we use to help guide you through the conveyancing journey, share documents, keep track of the progress of your transaction and collaborate with other service professionals, e.g., your agent or broker. You will receive an invite by email to your secure file in Rundl (called a ‘rundl’) as soon as we start working on your matter, and it is easy to create an account.
